Ohio Violation of Parole

Sometimes when a prisoner is released from prison, he needs to abide by certain terms and conditions put forth by the state. The state monitors the prisoner’s behavior after his release for a period of time. This is known as parole. The state may put the prisoner back in prison if he violates the terms of his release – which is known as violation of parole.

Violation of Parole in Ohio

The state may grant parole to a person for numerous reasons – the most common being good behavior. Parole is also given when a prisoner has committed a serious felony crime, like murder, and is deemed a potential threat to society. Once a person has been granted parole, he may be required to enroll into a “halfway house” (a rehabilitation center of sorts), find employment, check in regularly with his appointed parole officer, update his address, enroll into a substance abuse prevention programs, pass urine tests, and perform community service.

In Ohio, violation of parole can occur for a number of reasons – like if the recently released prisoner commits another crime or fails to adhere to the terms of the parole. 1 2

Revocation of Parole

The state may revoke the parole upon violation. The case will go to the Ohio Department of Rehabilitation and Correction (ODRC), where it will be heard by an administrative body. These hearings are unlike normal court hearings – the parolee is not given the same protections (like proof beyond reasonable doubt) that are otherwise present in a normal court. In such cases, the case is likely to go against the parolee. 3

This court, instead of rescinding your parole, may choose to assign the prisoner additional community service, place the prisoner under house arrest, place the prisoner under electronic surveillance, impose fines, and place the prisoner in a work-release center (among other penalties). 4
