If you are convicted of a first OVI offense, you may have to pay a minimum fine of $375 and a maximum fine of $1,075. You will also have to pay a driver's license reinstatement fee of $475.
Depending on your BAC (blood alcohol content), you could face some time in jail. If you are convicted of being impaired between a .08 and .17 BAC, you could be sentenced to three days in jail or three days in a Driver Intervention Program.
On the other hand, if you test above .17 BAC or refuse a breathe test while having a prior OVI conviction in the last 20 years, you can be sentenced to six days in jail and three days in a Driver Intervention Program.
Also, your license can be suspended anywhere from six months to three years upon your conviction for a first time OVI offense. This is called a Class Five license suspension. However, you may be eligible for occupational driving privileges 15 days from the date of your arrest. Occupational driving privileges may include travel to and from school or work.
Additionally, if you are convicted of having a BAC above .17, you may be required to install yellow license plates on your car or have an interlock device installed in your vehicle before you will be granted driving privileges.
