Ohio recently passed a new forfeiture statute that will require a criminal conviction before the police can permanently confiscate property for many civil forfeiture cases. This statute will go into effect on April 6, 2017.
In civil forfeiture, if the property is valued at under $15,000, the government must first convict the property owner in criminal court. This new threshold should protect property owners and protect private property rights. Additionally, the standard of proof to forfeit property in civil court is now clear and convincing instead of the low standard of preponderance of the evidence.
Under the new legislation, agencies cannot transfer seized property valued at $100,000 or less to the feds, except for contraband or property taken for federal criminal forfeiture. 1
