2nd Offense OVI Penalties

•     10 Days Jail Minimum
•     6 Months Jail Maximum
•     20 Days Minimum With .017 Breath Test (OR Past Refusal)
•     Mandatory Assessment & Treatment (if Recommended)
•    Fine: $525-$1,625
•     2nd Offense Driving Penalties

3rd Offense Penalties OVI Penalties

•     30 Days Jail Minimum
•     6 Months Jail Maximum
•     60 Days Minimum With .017 Breath Test (OR Past Refusal)
•     Mandatory Addiction Treatment
•    Fine: $350-$1,500
•     3rd Offense Driving Penalties

4th and 5th Offense OVI Penalties

•     Felony (Fourth Degree)
•     60 Days Jail Minimum
•     32 Months Prison Maximum
•     120 Days Minimum With .017 Breath Test (OR Past Refusal)
•     Mandatory Addiction Treatment
•     Fine: $1,350-$10,500
•     4th and 5th Degree Driving Penalties
