Ohio Felony drug possession penalties are based on the drug and the quantity. The greater the quantity of drugs, the higher degree of felony charged.

Felony Drug Possession Penalties in Ohio are strict and the laws complex. Different types of drugs are divided into five Schedules. These schedules are prioritized according to the risk of abuse.

Under Schedule I, the risk of addiction caused by drugs such as cocaine, marijuana, are higher than the other schedule. Under Ohio law, these drugs have little or no legal medicinal uses.

For example, if you are found guilty of possessing more than 27 grams of cocaine, you will be convicted of a 1rst degree felony which includes a monetary charge up to $20,000 and up to 11 years in prison.

If the amount of cocaine is less than 27 grams, then you may have to pay a fine varying from $2,500 to $20,000 and could be imprisoned for 6 months to 8 years (depending upon the amount).

Schedule II contains less hazardous drugs than those under Schedule I. They are more or less equally addictive to Schedule I drugs, but they have greater medicinal applicability.

Thereafter, Schedule III, IV and V include drugs that have lower abuse potential and have more medicinal applications. Hence, each Schedule and amount plays an indispensable role in judging an individual’s punishment.
